11.4) Delivery
Deliveries will be made to the address indicated by the User when placing the order for stock products within 2 to 4 business days following the receipt of the Order Confirmation email (this timeframe applies to deliveries within mainland Spain and Portugal; for orders to the Canary Islands or the rest of Europe, the delivery timeframe will be 4 to 6 business days). For pre-order items, the delivery will be made within the dates specified at the time of placing the order.
Shipments will be carried out within the following territories: Spain, France, and Portugal.
Home delivery will be made from Monday to Friday. If the User is not present at the specified address on the day of delivery, Aiguavista will attempt delivery again the following day. If the User is still absent, a second delivery attempt will be made. After that, the shipment will be deposited at a DHL service point. No deliveries will be made on Saturdays, Sundays, or public holidays.
Shipping Costs
The shipping cost for deliveries within the national territory (mainland Spain and the Balearic Islands) and Portugal is €4.00. Orders over €99 (including VAT) will have free shipping.
For orders to the Canary Islands or the rest of Europe, the shipping cost is €10.00. Orders over €199 (including VAT) will have free shipping.
The User can specify any relevant details regarding the shipment. During the purchase process, the User will be properly informed of any additional shipping and delivery charges for the products.
If there is any problem or unforeseen issue meeting the delivery date due to reasons attributable to Aiguavista, the User will be informed and given the option to accept the order or cancel it, with a full refund of the amount paid.
Aiguavista is not liable for delivery delays to the Canary Islands or abroad due to factors beyond the control of the carrier (such as delays from airlines, shipping companies, or issues related to loading/unloading, etc.).
Checking the Delivery
Before opening the package containing the product, the User must verify that the packaging and the number of delivered items match the information on the delivery note. If the User notices any anomaly before opening the product, Aiguavista expressly recommends not opening the seal or packaging and to note "accepted with reservation" on the delivery note, specifying the reasons for the discrepancy.
If the product has been damaged during transport, it is essential for the User to record this on the carrier’s delivery note.
If the User is not satisfied with the condition of the delivered products, they should immediately contact Aiguavista at the phone number: +34 639014564 (from 10 a.m. to 5 p.m.) or via email at eshop@aiguavista-concept.com, and always within 24 hours of receiving the order.
If the product is of poor quality, different from the one ordered, damaged, or in poor condition due to reasons attributable to Aiguavista, Aiguavista will cover the shipping costs for the delivery and return of the product without any additional charges. The amounts paid by the User will be fully refunded through the same payment method used on the website if the User does not wish to replace the product with another one in good condition that is available in stock. If the User prefers to return the product using a shipping method other than the one proposed by Aiguavista, and the selected transport company has higher rates than Aiguavista's standard rate, the User will bear only the difference in shipping costs.
Additionally, the User is informed that under no circumstances will Aiguavista be obligated to reimburse shipping costs beyond those incurred for delivery to the original address.
User Responsibility
Upon receiving the order, the User must always verify that the shipment is correct. The User is responsible for checking the order at the time of delivery and making any reservations or complaints that are justified. When the product is exchanged or returned to Aiguavista, it will be inspected, and Aiguavista will notify the User by email or phone whether the return, exchange, or refund is applicable according to these General Sales Conditions.
Claims and Complaints
If there is any discrepancy or issue at the time of delivery, the User may contact Aiguavista at the following email address: eshop@aiguavista-concept.com. No claims will be accepted after 30 days from the product delivery date.
Transfer of Risk
The risk for the purchased products will pass to the User at the time of delivery, regardless of when the User acquires ownership of the products.
Therefore, Aiguavista will not be held responsible for any theft, loss, damage, or deterioration of the products that occurs after they have been delivered to the User. This is in addition to any potential issues or discrepancies at the time of delivery.
Delivery Confirmation
Each delivery is considered completed once the product is made available to the User or an authorized third party, as evidenced by the tracking system used by the carrier. Aiguavista will be released from its delivery obligations as set out in this clause and will not be held liable in the following circumstances:
a) In cases of non-payment by the User, in accordance with applicable legal provisions.
b) Omission or inaccuracies in the information that the User must provide to Aiguavista at the time of placing the order.
