1. PURPOSE AND SCOPE OF APPLICATION
These General Terms and Conditions of Sale (hereinafter referred to as the "Terms and Conditions") govern the contractual sales relationship between Aiguavista 2018 S.L. (hereinafter "Aiguavista"), the owner of this website, and the user (hereinafter, the "User"), concerning all transactions made through Aiguavista’s online store at www.aiguavista.com. The sales relationship implies the delivery, in exchange for a stated price publicly displayed on our website, of one or more specific products listed on the site. Aiguavista 2018 S.L. is headquartered at Calle Ses Falugues number 44, Apt.2, -Begur (Girona), Postal Code 17255, with VAT number B-55333843. It is registered with the Girona Commercial Registry since 05/12/1998, Volume 3227, Folio 36, General Section of Companies, Sheet GI-64682. Any incident, complaint, or claim regarding a purchase made through the website must be communicated to the following email address: contact@aiguavista-concept.com. The geographic scope of the product offerings on the Aiguavista website includes Spain, France, and Portugal.
2. ACCEPTANCE AND MODIFICATION OF THE TERMS AND CONDITIONS
It is the User’s responsibility to be aware of the Terms and Conditions in effect at the start of the purchase process. By accepting these Terms, the User declares to be of legal age and to have the legal capacity to be bound by them. Therefore, it is important to carefully review the product information to understand the applicable general and/or specific terms of sale. These Terms may be supplemented or modified by specific conditions outlined for certain products, especially regarding the right of withdrawal, returns, exchanges, or refunds. Aiguavista may modify these Terms at any time. Such modifications will not affect purchases made before their entry into force, which will be governed by the Terms in effect at the time of purchase. These Terms may be saved at any time by the User through their internet browser and must be read and accepted before completing the purchase.
Therefore, purchasing one or more products from Aiguavista implies full and express acceptance of the Terms and Conditions in effect at the time of purchase, regardless of any future changes made to these Terms.
3. ACCESS TO ELECTRONIC PURCHASE
To make a purchase on the Aiguavista website (www.aiguavista.com), registration is not required. Purchases can be completed without registering.
However, registration is optional and free. It can be done via the "Register" tab on the website. Upon completion, the User will receive a confirmation email and will then have access to a customer account using their chosen username and password (or any other authentication method Aiguavista may provide).
In the User's account, relevant information can be found such as past orders, preferred products, issued invoices, provided shipping address, etc. The User may suspend or delete their account at any time by sending an email to: contact@aiguavista-concept.com.
4. ORDERS
Orders for in-stock products: Simply select the desired product, color, size, and quantity, and add it to your cart. Once product selection is complete, the User can review their cart (quantities, colors, sizes), validate the order, choose a payment method, and complete the purchase. A confirmation email will be sent within 24 hours including the order number, date, and a summary of the items purchased.
Orders for pre-order products: These are made-to-order items. Select the desired product, color, size, and quantity, then add it to your cart. After finalizing your selection, review the cart and complete the order. Choose your payment method and finalize the pre-payment. A confirmation email will be sent within 24 hours including the order number, date, and product summary. Aiguavista will begin manufacturing the item(s) to deliver them to the User’s specified address within the estimated period indicated on the product page.
If the User needs an invoice, they must request it when placing the order. The invoice will be sent by email in PDF format. If the User makes a mistake in entering data, they can modify it by emailing contact@aiguavista-concept.com.
If the change refers to the delivery address and the product has not yet been shipped, the new address will be used. For other changes, the User must wait for delivery and then initiate the appropriate return process.
If Aiguavista mistakenly delivers a different product than ordered, we will do everything necessary to deliver the correct product, collecting the incorrect item at no additional cost to the User.
If a product arrives damaged or with a quality issue attributable to Aiguavista, we will collect it and send a replacement from available stock at no additional cost. If the User prefers not to receive a replacement, a full refund will be issued using the same payment method.
In case a product becomes unavailable after an order has been placed, the User will be informed by email and the order will be canceled. Aiguavista does not guarantee permanent availability of its products and is not liable except in cases of intentional fault.

Order cancellations or rejections
Aiguavista may cancel a confirmed order or reject a placed order for the following reasons: technical or pricing errors on the website; lack of availability; security alerts indicating potential fraud; suspicion the User is a minor; failed delivery due to an incorrect address not attributable to Aiguavista; payment errors; or events of force majeure.

You have 30 calendar days from receipt of your order to request an exchange or return.
Returns
In-stock orders: If you purchased a product that was in stock and wish to return it, we will refund the amount using the same payment method, as long as the product is unused, in perfect condition, and in its original packaging.
Pre-order products: Returns are accepted only if the product has a quality defect, arrived damaged, or does not match the order. If everything is correct but you decide not to keep it, we will offer you a discount code for future purchases.
We will first inspect the returned product to verify its condition and then inform you by email or phone about the next steps.
Exchanges
You may request to exchange a product for another one in stock. The product must be in the same condition as when received. If the desired size or color is not available, we will offer other available options. If you want to switch to a different model, you must return the product and place a new order.
For in-stock items, any price difference will be refunded.
For pre-orders, refunds are not issued (except in cases of defect or shipping error). Instead, we will offer a discount code if applicable.
Shipping for returns and exchanges:
PREPARE THE PACKAGE INCLUDING THE DELIVERY NOTE
The User must securely repackage the product in its original packaging and include the delivery note.
It is important to indicate on this document the reason for the return or exchange (e.g., for a different size, color, model, or multiple reasons if applicable).
If the User cannot find the delivery note, they can access their customer account under the "My Purchases" section, select the order, and print the Return or Exchange Form. If the User does not yet have a customer account, they can enter their email and order number to view their order details.
FREE EXCHANGE OR RETURN VIA A SEUR/DPD SERVICE POINT
The User can drop off the package at a Seur/DPD Service Point as long as the package does not exceed the following dimensions: 120 × 60 × 60 cm. The steps are as follows:

A return label will be sent.

The User must print the shipping label received by email and attach it to the outside of the package.

The User can take the package to the Seur/DPD Service Point of their choice. You can check the nearest drop-off locations [HERE].

The User will wait to receive the replacement product, if that was the chosen option, and verify that it is in proper condition.
We will send a confirmation email regarding the refund, which will be processed within a maximum of 3 to 14 calendar days from the date we receive the returned product, provided the return meets the refund conditions set forth in these General Terms of Sale.
6. RETURN AND EXCHANGE POLICY
When processing a return or exchange, it’s important for the User to note the following:

Returns and exchanges are always accepted for other products that are in stock.

In the case of a return of a pre-order product, Aiguavista will offer the User a discount code to be used toward another pre-order or in-stock product, unless Aiguavista delivered a wrong, defective, or damaged item, or there is a verified quality issue. In such cases, we will issue a full refund using the same method of payment used by the User at checkout.

The time period to request a return or exchange is 30 calendar days from the date of delivery to the User.

Returned or exchanged products must be in the same condition as received. If the product has been opened, it must present a quality issue, be damaged, in poor condition, or not match the order to be eligible for return.

Once Aiguavista receives the returned or exchanged products, we will check their condition and proceed with the exchange or return, including a refund if applicable.

Products purchased as part of a set must be returned together. We do not accept partial returns or exchanges for individual items from a set.

Products with price variations based on size (e.g., sheets, duvet covers, etc.) cannot be exchanged for a different size—only returned.

7. RIGHT OF WITHDRAWAL AND ORDER RETURN
The User has the right to withdraw from the purchase contract within 14 calendar days without giving any reason. This withdrawal period expires 14 calendar days after the day on which the User, or a third party on their behalf (other than the courier), receives physical possession of the last item in the order. This right of withdrawal does not apply to customized products or pre-order items.
To exercise the right of withdrawal, the User must notify Aiguavista of their decision to withdraw from the contract by email (contact@aiguavista-concept.com), by phone (+34 639014564), or by mail to: Aiguavista, Calle Ses Falugues número 44, Apt.2, Begur (Girona), CP 17255, clearly stating their intent to withdraw. To meet the withdrawal deadline, the User must send the communication before the 14-day period expires.
Consequences of withdrawal
If the User withdraws from this contract, we will refund all payments received, including delivery costs (except for any additional costs resulting from the User’s choice of a delivery method other than the least expensive standard delivery we offer), without undue delay and in any event within 14 calendar days from the date we are informed of the decision to withdraw. The refund will be made using the same payment method used in the original transaction unless the User specifies otherwise. The User will not incur any fees as a result of the refund.
We may withhold the refund until we have received the goods, or until the User has provided proof of return, whichever comes first.
The User must return the goods directly to Aiguavista at: Calle Ses Falugues número 44, Apt.2, Begur (Girona), CP 17255, without undue delay and no later than 14 calendar days from the date they notify us of their decision to withdraw. The deadline is considered met if the goods are returned before the 14-day period ends. The User must bear the direct cost of returning the goods.
The User is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the items.
To exercise this right, the product must be in perfect condition. The User will be responsible for any depreciation in value caused by improper handling.
Return shipping costs under the right of withdrawal will be covered by Aiguavista only for orders originally shipped to Spain, Portugal, and France.
If the User chose a different delivery method than the one offered by Aiguavista when placing the order, those shipping costs will not be refunded.
If the returned products are not in perfect condition upon arrival at Aiguavista after the User has exercised the right of withdrawal, Aiguavista reserves the right to issue a partial refund and retain any amount necessary to cover damages caused by non-compliance with these conditions.
8. REFUNDS
Once we have verified the condition of the returned product, we will send an email to the User to confirm the refund of their order. The refund will be made using the same payment method used to place the order, and the timeframe for this refund will be between 3 and 14 calendar days from the date we receive the withdrawal notification, or in the case of a return or exchange, from the moment we receive the returned product, provided the case meets the refund conditions stated in these General Terms and Conditions of Sale. If the User returns the product using a courier service of their choice, the refund will be issued from the moment Aiguavista receives confirmation of the shipment or, if not available, upon receipt of the product.
9. GIFT CARD
At Aiguavista, we offer customers the option to purchase a “gift card” for a specified amount to give to whomever they wish.
This gift card will be valid for one year from the date it is delivered to the User and will include a code with a specified amount that can be deducted from future purchases made through the website.
The card will not be replaced, nor will any remaining balance be refunded, in the event of theft, loss, or damage.
Aiguavista will not be held responsible for any purchases made using the gift card or for how the User chooses to use it.
10. PRICES, PAYMENT METHOD, DELIVERY AND SHIPPING COSTS
10.1) Prices
The applicable prices for each product are those shown on the website on the date the order is placed, expressed in EUROS, and include VAT and any other applicable taxes or fees. Unless explicitly stated otherwise, these prices do not include insurance, shipping costs, or any additional services associated with the purchased products.
Special offers will be clearly identified as such, indicating the previous price and the promotional price.
Aiguavista reserves the right to make any changes it deems appropriate on the website at any time and without prior notice, including updates to products, services, and prices based on market conditions.
Aiguavista will charge the relevant amount via the bank details provided by the User on their customer account or via email, using the selected payment method at the time the order is validated.
Products will be invoiced at the price in effect at the time of purchase.
Shipping costs will be specified during the order process and will appear clearly at the end, indicating whether they are covered by the User or not.
Before confirming the order, the User will be able to view the final total price, with details of any surcharges or discounts applied, as well as transport, tax, customs, or other related costs.
The User will obtain ownership of the purchased products once full payment, including any applicable shipping costs, has been received.
10.2) Payment Method
After the User validates the order, they must proceed with payment of the indicated amount.
Payment shall be made by credit card. This payment is processed securely via the bank's payment gateway. The User’s order is charged in real time through the Virtual POS system, once the provided data has been verified.
ORDER CONFIRMATION – If you buy with Scalapay, you will receive your order and pay in 3 instalments. You confirm that the instalments will be sold to and purchased by Retail Instalments SPV 1 Limited, its affiliates, and their beneficiaries, and you hereby unconditionally and irrevocably authorize and consent to this sale.
All payments on the website are processed through the Paycomet electronic payment system. The User may also pay by credit or debit card and Bizum. Accepted card types: Visa, Mastercard, American Express, Diners Club, JCB, Union Pay.
To ensure proper handling, the User must notify Aiguavista as soon as possible of any unauthorized or fraudulent charges by contacting Aiguavista at contact@aiguavista-concept.com, by phone at +34 639014564, or by post at Calle Ses Falugues número 44, Apt.2, Begur (Girona) CP 17255.
10.3) Invoice
If the User requires an invoice in their name, they must send an email request to contact@aiguavista-concept.com, including the order number and billing address.
10.4) Delivery
Deliveries will be made to the address provided by the User at the time of order. For products in stock, delivery will occur within 2 to 4 business days after the Order Confirmation email is sent (this timeframe applies to deliveries in mainland Spain and Portugal; for the Canary Islands and the rest of Europe, delivery will take 4 to 6 business days). Pre-order products will be delivered within the timeframe stated at the time of purchase.
Orders will be shipped within Spain, France, and Portugal.
Home deliveries will be made Monday through Friday. If the User is not present at the delivery address, Aiguavista will attempt delivery again the next day. If the User is absent a second time, the package will be dropped off at a DHL service point. No deliveries will be made on Saturdays, Sundays, or holidays.
Shipping costs for deliveries within mainland Spain, the Balearic Islands, and Portugal are €4.00. Shipping is free for purchases over €99 (VAT included).
For deliveries to the Canary Islands or elsewhere in Europe, shipping costs €10.00. It is free for purchases over €199 (VAT included).
The User may provide specific delivery instructions. Shipping fees will be clearly shown during the purchase process.
If there is any issue or delay in meeting the delivery date due to circumstances attributable to Aiguavista, the User will be informed and offered the option to accept or cancel the order with a full refund of the amount paid.
Aiguavista is not liable for delays in delivery to islands or international destinations due to causes beyond the control of the carrier (e.g. airline, maritime, or road transport delays, loading/unloading issues, etc.).
Before opening the package, the User should verify the condition of the packaging and ensure the number of parcels delivered matches the delivery note. If the User notices any issues before opening the package, Aiguavista expressly recommends not opening the seal or packaging and writing “accepted with reservations” on the delivery note, stating the reason.
If the product has been damaged in transit, it is essential that the User note this on the carrier’s delivery slip.
If the User is not satisfied with the condition of the delivered products, they must contact Aiguavista immediately by phone at +34 639014564 (from 10:00 to 17:00) or by email at contact@aiguavista-concept.com, and always within 24 hours of receiving the order.
10. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
If the product is of poor quality, different from the one requested, or arrives damaged or in poor condition due to causes attributable to Aiguavista, the company will bear the shipping costs for both delivery and return, with no additional charges. The amounts paid by the User will be fully refunded through the same purchasing method used on the Website, should the User choose not to replace the product with another in good condition from available stock. If the User decides to return the goods using a shipping method different from the one proposed by Aiguavista, and the selected carrier charges a higher rate than Aiguavista’s standard rate, the User will only be responsible for the cost difference.
Likewise, the User is informed that under no circumstances will Aiguavista be obliged to reimburse shipping costs beyond those incurred for delivery to the original shipping address.
Therefore, the User must always check the order upon delivery to ensure it is correct. It is the User’s responsibility to check the order upon receipt and to make any justified claims or reservations. Once the product is returned or exchanged, Aiguavista will examine it and notify the User by email or phone whether the return, exchange, or refund is approved in accordance with these General Terms and Conditions of Sale.
If there is any discrepancy or issue at the time of delivery, the User may contact Aiguavista at the following email address: contact@aiguavista-concept.com. Claims will not be accepted more than 30 days after product delivery.
Risk is transferred to the User at the time of delivery, regardless of when ownership is transferred. Therefore, Aiguavista will not be liable for theft, robbery, deterioration, damage, or loss of the products after possession has been transferred to the User, except in the event of an issue reported at the time of delivery.
Each delivery is deemed completed once the product is made available to the User or an authorized third party, as recorded by the carrier's tracking system. Aiguavista is released from its delivery obligations and accepts no responsibility in the following cases:
a) In the event of non-payment by the User, in accordance with applicable law.
b) Omission or inaccuracy of the information the User must provide when placing the order.
11. WARRANTIES AND AIGUAVISTA'S RESPONSIBILITIES
If the User qualifies as a consumer under applicable legislation, all our products are guaranteed nationwide against manufacturing defects for 3 years, unless a different period is specified for a particular product.
Aiguavista will be liable for any lack of conformity that becomes apparent within three years of delivery.
Products are considered compliant if they conform to Aiguavista’s description, have the stated qualities and characteristics, are fit for the usual purposes of similar goods, and meet the expected quality standards given the nature of the product.
If a product is found not to conform, the User must notify Aiguavista. The same procedure as for a damaged or incorrect item will apply: the product will be replaced with one in good condition, if available in stock, at no additional charge, or the amount paid will be refunded, depending on the User’s choice, as per these General Terms and Conditions. Additionally, the User may request a proportional price reduction or the cancellation of the purchase and corresponding refund.
This commercial warranty does not affect the rights granted to consumers by current legislation.
The warranty explicitly excludes:
a) Damage due to transport, accidents, improper use, or other causes not related to normal usage after delivery. It only covers transport damage before delivery.
b) Transport of the product without original packaging.
c) Damage caused by animals, improper use or cleaning, or contact with chemicals.
d) Color fading due to exposure to sunlight or heat sources.
e) Any indirect losses or damages.
f) Breach of these Terms or improper use by the User or third parties, or damage not attributable to Aiguavista.
Aiguavista guarantees the quality of its products offered on the Website and respects all consumer rights under current legislation. Failure to comply with these Terms may result in the return of purchased products.
12. USER RESPONSIBILITIES
The User agrees to use the products lawfully, without violating current legislation or infringing third-party rights. The User guarantees the accuracy of the information provided when placing an order and must not cause harm to Aiguavista due to incorrect data.
13. FORCE MAJEURE
If, due to force majeure, a product becomes unavailable after the order is placed, the User will be notified by email, and the order will be cancelled. Aiguavista does not guarantee permanent product availability and is not liable for unavailability unless due to willful misconduct.
Partial cancellation of an order does not entitle the User to cancel the entire order, without prejudice to the right of withdrawal.
Aiguavista is not liable for full or partial non-compliance with obligations if caused by force majeure, including strikes, floods, fires, pandemics, etc. Obligations will be suspended during the force majeure event, and timeframes will be extended accordingly. Aiguavista will make all reasonable efforts to resolve the issue or find a solution to meet its obligations despite the force majeure.

The language of the contract between Aiguavista and the User is Spanish.

16. PERSONAL DATA PROTECTION
In compliance with Organic Law 3/2018 of December 5 and Regulation EU 2016/679 (GDPR), the personal data collected through this document will be processed by Aiguavista to fulfill the commercial relationship with the User. The data is collected for specific, legitimate purposes and will not be used for any other purpose.
Personal data may be shared with third parties only when necessary for the execution and control of the commercial relationship and only for the aforementioned purposes, in accordance with applicable legislation.

17. INTELLECTUAL PROPERTY
All trademarks, trade names, or distinctive signs on www.aiguavista.com are owned by Aiguavista or third parties, and use of the Website does not confer any rights over them.
The Website content is the intellectual property of Aiguavista or authorized third parties. Aiguavista owns or has rights to exploit, reproduce, distribute, publicly communicate, and transform this content.
The User acknowledges that these Terms do not transfer or assign any intellectual property rights. Use is only authorized as expressly stated in these Terms. Any unauthorized use may result in legal liability.
18. NULLITY OR ANNULABILITY OF CLAUSES
If any clause of these Terms is deemed null, void, or unlawful, such declaration shall not affect the validity of the remaining clauses, which will remain in force. The affected clause shall be modified or replaced to best preserve its intended effect.
19. COMPLIANCE WITH OBLIGATIONS
The User must fulfill all obligations under any agreement with Aiguavista or these Terms. Aiguavista’s failure to demand strict compliance or to exercise its rights shall not be deemed a waiver. Any waiver must be in writing and expressly communicated.
20. APPLICABLE LAW AND JURISDICTION
These Terms shall be governed and interpreted according to Spanish law, specifically Law 34/2002 on Information Society Services and Royal Legislative Decree 1/2007 of November 16 on Consumer Protection.
Any disputes regarding interpretation or execution of these Terms shall be subject to the jurisdiction of the courts of Girona (Spain), unless the User is a consumer, in which case the applicable jurisdiction shall prevail under the law.
